A 19- year-old unemployed man, Musa Ali, is to spend the next 90 days in prison for stealing a phone valued at N32, 000 at knife-point, an Ikeja Magistrates’ Court handed down the sentence on Friday.
The Magistrate, Mrs A. K. Dosunmu, gave the verdict after the accused pleaded guilty to the charge.
Dosunmu, who sentenced Ali without an option of fine, said the convict should serve the sentence with hard labour.
“You are hereby sentenced to three months imprisonment with hard labour and without an option of fine.
“The sentence will serve as a deterrent to others who might want to engage in similar acts,” she said.
The accused, who resides at Isheri-Olofun in Ogun, pleaded with the court to temper justice with mercy in sentencing him.
Earlier, the Prosecutor, Sgt. Dada Wasiu, told the court that the accused committed the offence on May 14 at Omole Phase II in Ikeja area.
He said the accused stole a mobile phone worth N32, 000, property of Mrs Jemrose Ehibe at knife-point.
“The accused armed himself with a knife to disposes the complainant of her Samsung GT-57500 phone.”
Wasiu said the complainant was returning from her workplace when the accused accosted her, pointed a knife at her and demanded her phone.
“He approached the complainant threatening to stab her if she refused to surrender her phone and out of fear, she gave him the phone, while the accused took to his heels.
“The complainant raised alarm, shouting thief, thief, and passersby pursued the accused and apprehended him and also recovered the phone.”
The offence contravened Section 287 of the Criminal Law of Lagos State, 2015 (Revised)
